Terms of Service

These terms govern your use of Therm, operated by Fouressco (“we”). By creating an account you agree to them. If you do not agree, do not use the service.
1. What Therm does
Therm connects to a smart thermostat you already own, records its readings, builds a model of how your building responds to weather and to your equipment, and — if you switch it on — adjusts your cooling setpoint to hold indoor humidity inside a comfort band.
We do not sell, install, service or warrant HVAC equipment or thermostats. You must own or be authorised to control the equipment you connect.
2. What Therm is not
Therm is a comfort and efficiency tool. It is not a safety system.
Do not rely on it to prevent frozen pipes, protect vulnerable occupants, protect pets, livestock, plants, artwork, wine, laboratory samples, server rooms or anything else where a temperature excursion causes harm or loss. It depends on your internet connection, your thermostat vendor’s cloud service, and our servers — any of which can fail.
If a temperature excursion in your property would be dangerous or costly, use equipment designed for that purpose, with its own alarms, independent of Therm.
3. Control is opt-in, and you keep the final say
Connecting a thermostat lets us read it. It does not let us change it. Remote control is a separate switch that is off by default, and you can turn it off at any time.
While control is on:
- We adjust only the cooling setpoint, within limits shown in the app.
- Changing the thermostat by hand always overrides us, and we stand down afterwards.
- Switching control off takes effect within one control cycle — normally under fifteen minutes.
- If our service stops for any reason, your thermostat keeps whatever ordinary setpoint it was last given and behaves as a normal thermostat. Nothing needs us to keep running.
You are responsible for the limits you set and for whether the resulting temperatures suit your household.
4. Energy use and savings
Any estimate of energy use, runtime, cost or savings shown by Therm is a calculation, not a measurement. It is derived from thermostat runtime and a model of your equipment, not from a meter. Real consumption depends on equipment condition, weather, occupancy and utility rates. We make no guarantee of savings, and estimates should not be used for billing, for regulatory reporting, or as the basis of a financial decision without independent verification.
5. Your account
Keep your credentials secure and tell us promptly if you suspect unauthorised access. You are responsible for activity under your account. You must be old enough to form a binding contract where you live, and at least 13.
Do not attempt to access other users’ data, disrupt the service, reverse-engineer it except as permitted by law, resell access without our written agreement, or use it to control equipment you are not authorised to control.
6. Third-party services
Therm depends on your thermostat vendor’s API, on a weather data source, and on a payment processor. Their availability, terms and rate limits are outside our control, and changes they make may reduce or interrupt functionality. Your use of a connected thermostat remains subject to that vendor’s own terms.
7. Subscriptions and payment
Paid plans are billed in advance on a recurring basis through Stripe, and renew automatically until cancelled. Prices and billing periods are shown before you subscribe.
- Cancelling stops future renewals. Access continues until the end of the period you have paid for.
- Refunds are not automatic for partial periods. Contact us and we will deal with it reasonably, and in any case as your local consumer law requires.
- Lapsed payment disables automated control. Data collection and your history remain available.
- Promotional codes may grant free or discounted access. They are not transferable, have no cash value, and we may withdraw a code for future redemptions at any time — but we will not revoke access already granted by one.
- Price changes will be notified at least 30 days in advance and apply from your next renewal.
Taxes are your responsibility where applicable.
8. Availability
We aim to keep Therm running continuously but do not promise uninterrupted service. We may suspend it for maintenance, and we may change or discontinue features. If we discontinue the service entirely, we will give you reasonable notice and an opportunity to export your data.
9. Your data
Our handling of your data is described in the Privacy Policy, which forms part of these terms. You retain ownership of your thermostat data. You grant us the licence needed to store and process it in order to provide the service, and to use aggregated, anonymised statistics that do not identify you or your home to improve the product.
10. Disclaimers and liability
To the fullest extent permitted by law, Therm is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, property damage, equipment damage or business interruption. Our total aggregate liability for any claim is limited to the greater of the amount you paid us in the twelve months preceding the claim, or US$100.
Nothing in these terms excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, for fraud, or any statutory consumer rights you have. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
11. Indemnity
You agree to indemnify us against claims arising from your misuse of the service, your breach of these terms, or your controlling equipment you were not authorised to control.
12. Termination
You may close your account at any time in the app. We may suspend or terminate an account that breaches these terms, or where required by law, giving reasonable notice where we practicably can. On termination, automated control stops and your data is handled as set out in the Privacy Policy.
13. Changes to these terms
We may update these terms. For material changes we will give notice in the app or by email before they take effect. Continuing to use Therm afterwards constitutes acceptance. If you do not accept, close your account.
14. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules, and the courts of the State of Delaware, USA have exclusive jurisdiction — except where mandatory law in your country of residence gives you the right to bring proceedings locally.
15. General
If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor in connection with a merger or sale of the business. These terms and the Privacy Policy are the entire agreement between us regarding Therm.
